Volunteer Work Policy
Purpose
The Villas at Riverbend Condominium Association ("Association") recognizes that owners and residents may wish to volunteer their time to assist with community projects. This policy is intended to promote safety, protect Association property, and reduce potential liability to volunteers, the Association, and its Board of Directors.
Eligibility
Volunteers must be owners, residents, resident family members, or other individuals approved by the Board of Directors. Volunteers must be at least eighteen (18) years of age.
Authorization
No Volunteer work may be performed on Association Property, including but not limited to, any portion of the common elements, without prior approval from the Board of Directors or the Association's property manager; save and except permitted activities listed below which are approved.
Board approval is required in the event of any dispute concerning the implementation or interpretation of this Policy.
Volunteers may not independently initiate, modify, or complete projects involving Association Property; save and except permitted activities listed below.
The Board reserves the right to approve, modify, suspend, or terminate any projects where Volunteers are used or any Volunteer activity at any time. The Board may terminate any volunteer at any time with or without cause.
Any expenditure of Association funds for Volunteer projects must be approved by the Board prior to the initiation of the project.
Permitted Activities
The following activities are approved by the Board of Directors, and may be performed by Volunteers without additional approval by the Board of Directors:
• Flower planting, watering and weeding
• Light landscaping, lawn care and garden maintenance
• Litter and debris removal
• Projects using step ladders or platform ladders, for light tasks such as changing lightbulbs, batteries and flags (one (1) additional person shall be present to steady the ladder)
• Tree trimming (without power tools)
• Painting of Board-approved surfaces
• Use of light household power tools (for example, household drills, reciprocating saws, etc.)
• Light carpentry work
• Light concrete repair
• Snow shoveling
• Assistance with community events
• Minor cleanup and beautification projects
• Minor projects which do not require the expenditure of Association funds and can be performed safely
• Other activities which are of a low-risk nature and not physically demanding given the physical capabilities of the person conducting the volunteer work.
Activities Prohibited Without Board Authorization
The following activities are prohibited, unless specifically authorized by the Board of Directors. The scope, nature and safety requirements of any such activity shall be as determined by the Board. A Volunteer Waiver and Release of Liability shall be signed by any Volunteer working on these projects:
• Electrical work
• Plumbing work
• Projects requiring the use of a straight ladder
Volunteers shall use only equipment approved for the project and shall follow all applicable safety instructions.
Volunteers are responsible for providing and using appropriate personal protective equipment when required. The Association will provide all necessary personal protective equipment, as needed for the project or work to be completed.
The Association will supply all necessary materials for the work or project and Volunteers may use personal tools and equipment not provided by the Association but do so at their own risk.
Prohibited Activities
The following activities are strictly prohibited:
• Structural repairs
• Roofing work
• Operation of heavy machinery or heavy power tools and equipment (by way of example only: chainsaws, table saws, circular saws, grinding tools, nail guns and other tools as determined by the board)
• Excavation or digging that may impact utilities
• Use of a motor vehicle to perform tasks on Association Property (for example, to use a motor vehicle to pull out a bush or tree)
• Work requiring a professional license or permit, unless the Volunteer holds such a permit or license
• Any activity determined by the Board to present an unreasonable safety or liability risk or is deemed in the sole discretion of the Board to be too physically demanding given the physical capabilities of the person conducting the volunteer work.
Incident Reporting
All personal injuries, accidents, and property damage must be reported immediately.
Insurance and Liability
Participation in Volunteer activities does not guarantee coverage under any Association insurance policy in the event of a loss or injury.
Volunteer Waiver of Liability
The Board may require any Volunteer to sign a Volunteer Waiver and Release of Liability at any time within its sole discretion.
Right to Refuse Participation
The Association reserves the right to deny, suspend, or terminate participation whenever the Board determines (in the Board’s sole discretion) that such participation may create a safety hazard to the individual as well as others, or liability, operational, or community concerns.
Maintaining Records
The Board Secretary and/or Property Manager shall be responsible for maintaining a record of all signed Volunteer Waiver of Liability and Release forms.
